Jennifer Smith and Jeremy Riley Publish on Estate Planning in the Event of Incapacity as a Result of Dementia
WILMINGTON, DE (September 26, 2021) – McCollom D’Emilio Smith Uebler LLC partner Jennifer Smith and associate Jeremy Riley co-authored an article addressing some of the tools available under Delaware law, that can be utilized by people with diminished capacity to plan ahead for incapacity and control decisions with respect to their health and property after they are no longer able to make those decisions for themselves.
In addition to examining estate planning tools for people that may develop dementia, Smith’s and Riley’s article also addresses the legal standards applied in determining whether and when a person has capacity to create estate planning instruments and when such instruments become effective.
